Recent amendments to the Resource Management Act 1991 (RMA) introduced a new power for the Minister for the Environment (now delegated to the Minister Responsible for RMA Reform) to recommend regulations to remove or modify plan and policy statement provisions that are negatively impacting economic growth, development capacity or employment.
The mayor of New Plymouth requested that the new power be used to investigate specific operative provisions in the Part Operative New Plymouth District Plan 2025 (NPDP). Minister Bishop agreed to receive further advice on the request and initiate an investigation in accordance with section 360J(1) of the RMA.
This report has been prepared in accordance with section 360J(2) of the RMA to set out the findings of the investigation. This report makes recommendations on how the NPDP provisions could be modified to lessen negative impacts on economic growth, development capacity and employment while ensuring the requirements of section 360I(2)(c) are met and that any amendments are consistent with Part 2 of the RMA.
