This fact sheet outlines a series of targeted amendments to strengthen and improve certain compliance and enforcement provisions of the Resource Management Act 1991 as introduced by the Resource Management (Consenting and Other System Changes) Amendment Act 2025.
The amendments reduce the maximum imprisonment term to 18 months, increase fines for environmental offences, expand cost recovery powers for councils and allow regulators to consider compliance history in decision-making.
There are also amendments in relation to removing insurance coverage for fines, excessive noise controls, electronic document service, abatement notice powers, cost recovery for monitoring and compliance, and the correction of a drafting issue in section 38 relating to the warranting of enforcement officers.
