Request for information relating to Azuma Property Ltd and Hopper Developments Ltd in the Fast Track Approvals Bill

I hereby request, pursuant to s 12(1) of the Official Information Act 1982 (“OIA”), all official information held by your departments [combined request: and from the Fast-Track Projects Advisory Group - see note] relating to any approaches to, or by, Azuma Property Ltd, Hopper Developments Ltd, and any related entities, including their directors, shareholders, agents, representatives, and/or assigns (the "entities”), for inclusion of a marina project at Waipiro Bay, Bay of Islands (the “Project”), within Schedule 2 of the Fast Track Approvals Bill (“FTAB”).

• For the avoidance of doubt, this request includes:
  • copies of any correspondence sent to, or received from, the entities in relation to the potential inclusion of the Project within Schedule 2 of the FTAB, including any application material submitted by the entities through the dedicated portal established by your department(s);
  • copies of any correspondence between your respective departments and members of the Fast-Track Projects Advisory Group (or its Secretariat) in relation to the Project, including the outputs of any initial checks and related tasks;1 minutes or notes of any meetings between officials in your respective departments and the entities in relation to the Project and its potential inclusion within Schedule 2 of the FTAB, including diary entries;
  • copies of any correspondence between officials in relation to the potential inclusion of the Project within Schedule 2 of the FTAB; and
  • records of any decisions (if made) to include the Project within Schedule 2 of the

FTAB, and if not yet made, confirmation of the same.

4. I ask that you treat this request as urgent, on the grounds that the responses will inform

steps that may need to be taken to preserve the legal position of my clients, includin judicial review.

5. I would be happy to receive electronic copies of any documents which fall within the above request. I can also confirm that my clients would be willing to accept a reasonable charge for the provision of such information on an urgent basis.
