Resource management (exemption) regulations 1996

The regulations enable a biological insecticide containing Bacillus thuringiensis var. kurstaki to be discharged as part of a spraying programme under Part 6 or Part 7 of the Biosecurity Act 1993.

Role of the regulations

The Resource Management (Exemption) Regulations 1996 enable a biological insecticide containing Bacillus thuringiensis var. kurstaki to be discharged as part of a spraying programme under Part 6 or Part 7 of the Biosecurity Act 1993.

This is in spite of prohibitions contained in section 15 of the Resource Management Act 1991 [New Zealand Legislation website] on discharging contaminants into the environment.

When the insecticide is discharged from an aircraft the discharge must be authorised jointly by the Ministers of Forestry, Health and Conservation.
