Infringement offences regulations

The Resource Management (Infringement Offences) Regulations 1999 (the Regulations) prescribe offences under the RMA for which an infringement notice can be issued. The infringement offences include breaches of certain obligations under the RMA, as well as breaches of stock exclusion regulations, and of farm plan regulations. Enforcement officers appointed by Councils or the Environmental Protection Authority can issue infringement notices, which incur a fixed fee, prescribed in the Regulations.

The regulations came into force on 1 February 2000.

The 2025 amendment regulations will come into force on 4 September 2025.

About the regulations

Schedule 1 of the regulations sets out infringement offences and fees for contravening various sections of the RMA. The fee for committing an infringement offence set out in schedule 1 ranges from $600 to $2000 for individuals, and from $1200 to $4000 for companies, depending on the offence. 
 
Schedule 1A of the regulations sets out infringement offences and fees for contravening the Resource Management (Stock Exclusion) Regulations 2020. The fee for committing an infringement offence set out in schedule 1A ranges from $2000 for an individual, to $4000 for a company, or a fee $100 per animal to which the non-compliance relates, up to a maximum of $2000. 
 
Schedule 1B of the regulations sets out infringement offences and fees for contravening the Resource Management (Freshwater Farm Plans) Regulations 2023. The fee for committing an infringement offence set out in schedule 1B is $1500.

Schedules 2 and 3 set out the prescribed forms for enforcement authorities to use when issuing infringement notices and reminders. The forms include a summary of rights for parties that have been served an infringement notice.

Changes to the regulations

In August 2025, the Regulations were amended to update the offences and fees for breaching the RMA. This was the first time the RMA infringement offences and fees have been updated since 1999, and the amendments were to ensure the Regulations continue to be an effective deterrent.

The changes include:  

  • Increasing the fees for infringement offences committed by individuals and introducing new higher fees for companies.  
  • Separating the existing land use infringement offence into two different offences, with different fees 
  • Broadening the scope of the dumping waste offence in the CMA. 
  • Updating the summary of rights in the statutory forms for infringement and reminder notices to more clearly state the potential outcomes of seeking a court hearing to contest an infringement notice.   

Reviewing the regulations

A review of the Regulations was commenced in early 2023. A discussion document was publicly released proposing various options for amending the Regulations, and consultation ran from 7 February 2023 until 31 March 2023. 

Amended regulations were published in the NZ Gazette on 7 August 2025, which made changes to Schedules 1, 2 and 3 of the Regulations. The changes come into effect on 4 September 2025.
