Background
1. This OIA request relates to the decision of the Minister of Conservation in 7 March 2006 refusing to grant the two coastal permits required for the restricted coastal activities for the Whangamata Marina Society Inc’s proposed marina at Whangamata. This decision of Minister Carter was judicially reviewed in Whangamata Marina Society Inc v Attorney-General [2007] 1 NZLR 252.
2. The Minister was subsequently directed by Fogarty J to reconsider the whole matter to which the two restricted coastal activity applications related. This reconsideration was not completed by Minister Carter, instead being delegated to Minister for the Environment, Minister Benson-Pope (the Marina decision).
