Details of the request
- This letter is a request for information under the Official Information Act 1982. It is sent by email.
- We request the following in relation to the second Emissions Reduction Plan (ERP2):
- Was there any consultation with Māori or Māori groups on the development of the ERP2, if so, which groups were consulted and how was consultation undertaken;
- Any advice, internal memoranda, aide memoires or briefings relating to the Māori interest in climate change, adaptation, and/or mitigation in the energy, transport, agriculture, forestry and waste sectors;
- Any advice, internal memoranda, aide memoires or briefings relating to Te Tiriti o Waitangi and the ERP2, including with regard to the ETS, system plans and cross sector policies, sector policies and plans and businesses, communities and households in the transition;
- Any advice, internal memoranda, aide memoires or briefings, considering the 2023 Draft advice to inform the strategic direction of the Government’s second emissions reduction plan.
- In the Discussion document for ERP2, each sector plan analyses the impact on iwi and Māori. These sections have not been carried through to the final ERP2. We request any information or documents relating to why sector -specific impacts on iwi and Māori are not analysed in ERP2.
- In the Discussion document for ERP2, there is a section on Te Tiriti o Waitangi commitments. We request any information or documents relating to why this section was not included in the final ERP2.
- As the Act states, we anticipate your response to this request within 20 days. We also expect that your response will be compliant with the provision and spirit of the Official Information Act 1982.
- We are making this request in good faith and wish to avoid bland assertions of privilege, confidentiality and other general unsupported objections that are designed to deter us from pursuing disclosure. We are not seeking to obtain an improper commercial advantage or other inappropriate disclosure.
- We are making this request on behalf of people who are directly affected by this matter and who, like many natural persons seeking personal information, would like to know what records the Government has regarding matters they are involved in. We anticipate that any boilerplate objections that may be made can be addressed by redacting protected information. In addition, we are prepared to enter into a confidentiality agreement to protect truly confidential information.
- If you are unable to provide any of the requested information, please provide us with the grounds and supporting facts for the inability to comply. Any refusal to produce must be in a form that will permit adequate review of the decision to withhold. We are prepared to pursue our rights to information and anticipate that a refusal to produce will be reviewed. Also, if you are aware that requested information exists but is not in your possession, please be so kind as to advise us as to the holder of the information requested.
