Details of the request
s41 of the Climate Change Response (Emissions Trading Reform) Amendment Bill released today would insert new clauses into the Climate Change Response Act governing the new "auction monitor". One of the new clauses - 30GF - would require the auction monitor to keep secret all information that comes into its knowledge when performing its functions or exercising its powers. base don a ruling on a similar clause, this clause seems to over-ride the OIA.
I would like to request the following information under the OIA:
* all advice and communications on the drafting of this clause of the Climate Change Response (Emissions Trading Reform) Amendment Bill. I'm particularly interested in seeing the justification for the amendment, and who (if anyone) was consulted about it.
